Not as Hak Milik, the freehold title Indonesian law reserves for its own citizens. A foreigner buying here uses one of three legal routes instead: Hak Sewa leasehold, Hak Pakai with a residency permit, or a PT PMA company holding HGB. Every villa listing you will see for this village already sits inside one of those three.
Freehold Sits Off the Table by Law
Hak Milik cannot be held by a foreign national or by a PT PMA, a foreign-invested company, full stop. That rule comes from the Basic Agrarian Law (UUPA), specifically Articles 21 and 9, and it has not moved regardless of how much a broker might imply otherwise.
Nothing about a large budget, a good relationship with a seller, or a long-term visa changes this. If a structure is being pitched to you as freehold ownership, it is either a different legal vehicle wearing that label loosely, or it is not legal at all.
Three Routes Foreigners Actually Use
Each route trades something for something else, and none of them is Hak Milik with a different name on it:
- Hak Sewa (leasehold) puts a notarised lease in your hand rather than a share of the title. BPN keeps no record of it, and your name never appears on any certificate, per BaliPropertyRules.
- Hak Pakai (right of use) opens up to anyone holding a valid KITAS or KITAP, but only above a price floor: Kompas Properti's 2023 figures set that floor at Rp 5 billion where the property is a landed house within Bali Province. The initial term runs 30 years, with renewals stepping it up to a ceiling of 60 to 80 years depending on the land underneath.
- HGB via PT PMA lets a foreign-invested company hold Right to Build land. Per Bali Exception, that includes a plot the seller's Hak Milik converts into the moment the sale completes. Terms mirror Hak Pakai's staged structure.
What Pererenan's Own Stock Is Sold Under
This is not an abstract legal question for this market. Bali Home Immo and Magnum Estate price the entry-level leasehold stock here from roughly USD 130,000 up to about 179,000, with the tenure note on those listings simply reading "leasehold, various terms." Premium and beachfront stock spans a mix of leasehold and freehold across more than a hundred Propertia listings, but the freehold half of that mix belongs to Indonesian sellers and buyers only: a foreign buyer reaching for one of those listings still needs Hak Sewa, Hak Pakai or a PT PMA structure to actually take it on.
Traditional Balinese compound houses away from the tourist strip remain in local hands under Hak Milik. That stock was never on the table for a foreign buyer to begin with, and it is worth understanding why before a broker frames it as an opportunity.
Why the Nominee Shortcut Is Void
Some agents still float a nominee deal: an Indonesian citizen's name sits on the Hak Milik certificate while a foreign buyer quietly holds the real interest. That trick has never worked legally, and the excuses for trying it keep running out.
The Basic Agrarian Law already closes the door.
UUPA Article 26(2) forbids handing land rights to a foreigner, whether the transfer is open or dressed up as something else, and Indonesia's Supreme Court backed that up in Surat Edaran Mahkamah Agung (SEMA) 10/2020, telling courts to treat every nominee agreement as null and void because it cannot meet the lawful-cause requirement in Civil Code Article 1320, per Melayunesia Law and Jurnal Aktual Justice.
Bali tightened the net further in 2026.
Perda Provinsi Bali Nomor 4 Tahun 2026 rules out land ownership transferred via a nominee and attaches demolition orders, fines, permit cancellation and criminal charges to the related farmland-conversion breaches, per NusaBali. Once a court voids the deal, the buyer is left holding nothing, whatever a side letter promised.
What a PT PMA Actually Costs to Run
A PT PMA fits someone building a rental operation, not a buyer after a single holiday home; of the three routes it carries the most setup work. Bali Exception cites BKPM Regulation 5/2025 for two figures tied to that setup: paid-up capital near Rp 2.5 billion, and a Rp 10 billion investment plan required for each business licence at each location.
